        (试行)政策解读

 

   一、《云南省劳动关系和谐企业评价标准(试行)》适用的范围?

答:云南省全省范围内的企业都可自愿参加。

二、《云南省劳动关系和谐企业评价标准(试行)》制订的依据是什么?

   答:《云南省劳动关系和谐企业评价标准(试行)》制订的依据是《中共中央国务院关于构建和谐劳动关系的意见》《中共云南省委云南省人民政府关于进一步构建和谐劳动关系的实施意见》。

三、企业可以向哪个部门申请劳动关系和谐企业评价,需要办理什么手续?

答:企业可以可在每年2月、5月或8月向企业所在地县级人力资源和社会保障部门申请劳动关系和谐企业评价,企业提出申报应填写《劳动关系和谐企业评价申报表》、《劳动关系和谐企业评价指标表》和企业创建和谐劳动关系基本情况概述材料。

四、劳动关系和谐企业的评价工作是由哪个部门组织实施的?

    由县级人力资源和社会保障部门、工会组织和企业代表组织在当地党委、政府领导下,按照县级构建和谐劳动关系工作领导小组的要求,依托协调劳动关系三方机制共同做好具体组织实施工作。

五、如何进行劳动关系和谐企业评价?

答:采用百分制进行测评,基础分100分,由基础指标45分(包含了企业劳动用工管理、规章制度、工作时间、休息休假、社会保险、劳动保护、劳动条件和职业危害防护等内容)、建制指标25分(包含了党组织、工会组织、民主管理、集体协商、争议调处等内容)、创建指标30分(包含了工资福利、职业技能培训、文化建设、职工满意度等内容)组成。加分指标4分,扣分指标4分。经测评和评审,企业基础指标达42分,总分达90以上的,评价为“劳动关系和谐企业”。测评和评审采用查阅资料、实地查验、开展职工问卷调查、听取报告、查阅相关部门数据等方式进行。

六、劳动关系和谐企业评价的具体程序是什么?

答:县级人力资源和社会保障部门受理企业申请后,按照《云南省劳动关系和谐企业评价标准(试行)》在15个工作日以内完成测评,形成测评意见。按照三方办公室的提议召集县级协调劳动关系三方联席会议,并将参会单位扩展到构建和谐劳动关系领导小组相关成员单位,依据《云南省劳动关系和谐企业评价标准(试行)》、企业申报材料、测评情况等,对申报企业的劳动关系状况进行评审,确定企业最终得分,形成评审结果。县级人力资源和社会保障部门将评审结果书面通知申报企业。县级协调劳动关系三方办公室将本地区劳动关系和谐企业评价情况上报本级构建和谐劳动关系工作领导小组和市级协调劳动关系三方办公室,由市级汇总情况后报省级协调劳动关系三方办公室备案。

     七、企业申报后,经评审未达到劳动关系和谐企业标准的,对企业有什么影响吗?

     答:没有影响,对未被评价为“劳动关系和谐企业”的申报企业,县级人力资源和社会保障部门、工会组织和企业代表组织将开展有针对性的服务和指导,通过座谈培训、政策讲解、答疑解惑、上门服务、支部共建等方式加强指导。6个月后,再对其开展一次评审工作。

八、对申报劳动关系和谐企业评价的企业数有限制吗?

答:没有限制,鼓励各地在企业自愿参评的基础上,通过广泛宣传和积极引导,充分调动企业管理者与职工的参与度,不断扩大评价工作的覆盖面。截至2018年8月底前,各州市完成劳动关系和谐企业评价的户数(不包含复验企业户数)分别为昆明市、曲靖市不低于80户,玉溪市、红河州不低于60户,版纳州、怒江州、迪庆州不低于30户,其他州市不低于40户。2019年各州市完成的评价户数不得少于2018年的户数的150%。以后年度,按照循序渐进、不断拓展的原则,积极扩大评价工作的覆盖面,由各州市根据工作推进情况确定评价户数。

    九、对评价为劳动关系和谐企业的企业有什么激励措施?

答:一是被评价为“劳动关系和谐企业”的企业在各级人力资源社会保障部门、工会组织、企业代表组织门户网站和云南人力资源社会保障12333公共服务网上进行公布,并将评价结果归入企业劳动保障守法诚信档案,按照劳动保障守法诚信A级单位管理,减少劳动保障检查频次,一般不纳入专项检查范围。二是逐步将劳动关系和谐企业创建情况纳入企业信用评价体系,并作为银行信用评级的重要依据。三是被评价为“劳动关系和谐企业”的企业可直接申报作为“云南省模范劳动关系和谐企业”评选表彰候选企业。由省级协调劳动关系三方联合相关部门进行评审并公示后,授予“云南省模范劳动关系和谐企业”称号,并采取适当方式予以表彰,通过新闻媒体向社会公布、宣传。四是在政策扶持、资金支持、融资担保、贷款审查、贷款额度、职工培训、政府采购等方面,对劳动关系和谐企业给予倾斜和优先安排。五是被评价为“劳动关系和谐企业”的经营管理者,在参评“五一劳动奖状”“五一劳动奖章”“劳动模范”等荣誉时,在同等条件下优先推荐。

     十、对已被评价为“劳动关系和谐企业”的企业,有退出机制吗?

答:已被评价为“劳动关系和谐企业”的企业,若出现《云南省劳动关系和谐企业评价标准(试行)》第六项不得评价为和谐劳动关系企业的情形的,由县级协调劳动关系三方会同有关部门召集联席会议,研究决定取消其评价结果,并将有关情况报本级构建和谐劳动关系工作领导小组和市级协调劳动关系三方办公室,由市级报省级协调劳动关系三方办公室备案。

十一、劳动关系和谐企业评价标准对企业劳动用工管理水平有什么具体要求?

答:依法招用职工,规范用工管理。依法签订劳动合同,签订率不低于98%。劳动合同内容合法、条款完备。劳动合同一式三份,由用人单位和劳动者各执一份,存职工档案一份。依法建立职工名册,办理劳动用工登记,全面实现职工实名制管理,规范建立职工档案。依法履行、变更、续订、解除、终止劳动合同。使用劳务派遣人员符合法律法规规定。以法定货币形式按时足额支付职工工资,工资不低于当地最低工资标准。

十二、劳动关系和谐企业评价标准对企业劳动用工规章制度有什么具体要求?

     答:一是制度健全:依法建立和完善劳动报酬、工作时间、休息休假、社会保险和福利、职工培训、劳动纪律等制度,内容合法有效。二是程序合法:制定劳动规章制度和决定涉及职工切身利益的重大事项,应当经职工(代表)大会或者全体职工讨论;与工会或者职工代表平等协商确定。三是公示告知:劳动规章制度、重大事项应公示告知职工。

    十三、劳动关系和谐企业评价标准对企业在工作时间和休息休假方面有什么具体要求?

    答:依法执行国家规定的工作时间。执行不定时和综合计算工时工作制的,履行审批手续,并遵守相关规定。延长工作时间符合法律法规规定,并依法支付加班加点工资。依法安排职工休息休假,执行全国年节、纪念日假期规定及带薪年休假规定。

     十四、劳动关系和谐企业评价标准对企业在社会保险方面有什么具体要求?

答:一是依法申报、按时足额缴纳各项社会保险费。二是按时申报应享受的各项社会保险待遇。

十五、劳动关系和谐企业评价标准对企业在劳动保护、劳动条件和职业危害防护方面有什么具体要求?

     答:采取有效的防护措施,为职工提供职业病防护用品并进行相应的职业健康检查。加强职工劳动保护,采取措施改善女职工劳动安全卫生条件,对女职工进行劳动安全卫生知识培训,遵守女职工禁忌从事的劳动范围的规定。  

     十六、劳动关系和谐企业评价标准对企业在党组织建制方面有什么具体要求?

答:建立党组织,强化党群组织合力支持职工代表大会开展工作,维护各方的合法权益,促进企业健康发展。 

     十七、劳动关系和谐企业评价标准对企业在工会建制方面有什么具体要求?

     答:依法组建工会组织,工会依法取得社会团体法人资格。按时足额拨缴工会经费,工会建立独立账户。设立工会劳动法律监督委员会。

     十八、劳动关系和谐企业评价标准对企业在民主管理建制方面有什么具体要求?

     答:依法建立职工(代表)大会制度,股份制企业依法设立职工董事、职工监事。职工(代表)大会每年至少召开1次。实行厂务公开制度或建立与企业相适应的其他民主管理制度,公开内容全面、真实、及时。

     十九、劳动关系和谐企业评价标准对企业在集体协商建制方面有什么具体要求?

答:建立集体协商制度。依法签订集体合同(综合集体合同和工资、女职工特殊保护专项集体合同),或参与区域性、行业性集体协商,签订区域性、行业性集体合同。集体合同按规定报送人社部门审核,生效的集体合同向职工公示。

     二十、劳动关系和谐企业评价标准对企业在争议调处建制方面有什么具体要求?

答:建立健全企业劳动争议调解组织。采取有效措施畅通职工诉求表达渠道。劳动争议调处及时有效。

     二十一、劳动关系和谐企业评价标准对企业在工资福利方面有什么具体要求?

答:建立以工资协商为主要形式的工资分配决定机制和工资水平调整机制。近两年职工工资增长水平不低于当地工资指导线基准线标准或者职工平均工资水平不低于当地城镇职工平均工资水平。建立企业年金制度。建立职工医疗互助制度。依法缴纳住房公积金。

     二十二、劳动关系和谐企业评价标准对企业在职业技能培训方面有什么具体要求?

 答:建立技能人才培养培训实施计划和职工培训制度,组织开展常态化的职业技能培训。落实职工职业技能水平与薪酬待遇相挂钩制度。

    二十三、劳动关系和谐企业评价标准对企业在文化建设方面有什么具体要求?

 答:重视企业文化建设,设立职工之家、职工书屋等,组织开展职工文体活动。组织开展职工合理化建议活动。

     二十四、劳动关系和谐企业评价标准在职工对企业劳动关系状况的满意度方面什么具体要求?

 答:劳动关系和谐企业评价标准要求企业要就职工对工作环境、劳动条件、收入待遇、社保缴纳、休息休假、人文关怀等企业劳动关系状况进行满意度测评,参评人数不少于在职职工人数80%。     二十五、企业存在哪种情形时,不得评价为劳动关系和谐企业?

答:一是按照《云南省企业劳动保障守法诚信等级评价办法》的规定,企业劳动保障守法诚信等级被评定为B级以下的;二是因重大劳动保障违法行为被人力资源社会保障部门向社会公布的;三是因劳动保障问题引发群体性事件的;四是存在拖欠1名劳动者3个月以上劳动报酬且数额达到5000元、拖欠10名以上劳动者劳动报酬且数额累计达到30000元情形的或者存在拒不支付劳动报酬、强迫劳动、雇用童工从事危重劳动、骗取社会保险金或其他社会保障待遇等违法犯罪行为的;拒不执行生效的劳动争议调解协议、仲裁裁决或法院判决的;职工在25人以上的企业未建立工会组织的。
